Profiles in Judicial Fecal Matter: Mary Lane Mikva, Well-Connected Pig and Cook County Circuit “Judge”

On November 12, 2012, the Wall Street Journal published Joe Palazollo’s piece “Judge Bounces Two More Consumer Fraud Lawsuits Against Law Schools.” Check out the following excerpt:

“Cook County Circuit Judge Mary Mikva dismissed the lawsuits against John Marshall and Kent on Friday. She ruled from the bench, and later issued one-page written orders.

According to lawyers who attended the hearing, Judge Mikva said she agreed with the reasoning of her colleague, Judge Neil Cohen, who in September spiked a lawsuit filed by graduates of DePaul University College of Law.

In that case, Judge Cohen said it wasn’t DePaul’s fault that the graduates entered the workforce during “the height of a tumultuous and deep recession that seriously affected employment in the legal profession.” [Emphasis mine]

At least, the cockroach didn’t bother writing a lengthy opinion, in a ridiculous attempt to justify her decision. Apparently, law schools can claim high employment “placement” rates - even though most recent graduates find jobs through their own efforts - and prospective students should know better than to believe these “institutions of higher education.”

Quit Blaming the Recession, Idiot:

On June 13, 2010, Brian Tamanaha posted a Balkinization entry entitled "Wake Up, Fellow Law Professors, to the Casualties of Our Enterprise."  Take a look at the following excerpt:

"This dismal situation was not created by the current recession—which merely spread the pain up the chain into the lower reaches of elite schools. This has been going on for years."

Of course, "law professors," deans, shills and "judges" continue to blame the current job market on the 2008 crash.  If the legal sector does not improve ten years from now, these bitches and hags will keep relying on this as an excuse.  $omehow, the bastards don't cut their admissions drastically - even though they are aware of the glutted attorney field.

Mary Mikva’s father is former congre$$man Abner Mikva. Do you think that this bitch ever had a problem breaking into the legal field?!?!

For $ome rea$on, this butter cow “forgot” to mention her influential father. Hell, she even listed her personal interests of riding her bike, traveling and the local theater. Apparently, Mary feels or believes that she made it on her own efforts.

Conclusion: Do not expect a political solution to the problem of crushing student debt. “Judges” typically serve as bagmen to industry. These pets are nothing more than politicians in black dresses. These puppets/public $ervant$ do not have the balls to go against big business interests. No one should be surprised by this decision from a Crook County “judge” - especially one with such extensive connections in Chicago politics. The schools will cite to this decision as “proof” that the cases against them had no merit. Furthermore, in a sick twist, the commodes will use these dismissals to “show” law students that “the system works.”


  1. People like Judge Mikva are disconnected from reality. She probably believes, like Victoria Pynchon, that she earned every accolade in her life without giving credit to the fact that her DNA pedigree is what got her there (i.e., being born on third base while thinking you just hit a triple). To her, people like Nando and recent law grads are whiners who are experiencing buyers' remorse. These judges (who are tossing out these cases) gloss over the fact that the law schools are committing fraud using fuzzy stats. Any other enterprise using juked stats gets put down but law schools will allow to operate. The scam will have a day of reckoning. LSAC is reporting another consecutive drop of applicants. Eventually, within a year or two, some law schools will have to consider shutting down. I pray for a domino effect and I cannot wait until these law professors come clamoring for their lateral partnership positions at Biglaw.

    The best fix is to bring back consumer bankruptcy protections for student loan debt.

    A serious examination at what is and what is not blatant usury is long past due.

    Be they deans, administrators, politicians, policymakers, or even judges, at the core it is ultimately a complicated game of musical chairs, and you have to be thinking years down the road about where your spot will be. Elbow whoever is in your way. Follow the money and you will find the real answers and motivations.

    1. The main thing is that, once you get into law and can stay in it longer than five years, you're in law for life. In the case of Judge Mikva, her entire life has revolved around some form of government or legal service because of her father the congressman. As it stands she'll probably die on the bench, because as you know, the people with deep connections to the law never quit (the senior partner who does one case a year, the scumbag founder of Thomas Cooley who still gets $400,000/year for doing something, etc.) When you have been a lawyer for 30 years, there is no other job you can slide into.

    “Over the last year, there's been a lot of news about law schools being sued for fudging their employment numbers by graduates having trouble finding, well, employment. Yesterday, Joe Palazzolo at the Law Blog provided an update on the fate of two such lawsuits - a Chicago judge spiked them.

    Cook County Circuit Judge Mary Mikva threw out cases filed against the John Marshall Law School and Chicago-Kent College of Law, issuing just a one-page order. In court, however, she was a little more loquacious, according to lawyers who passed the info on to the law blog. Mikva said she followed the reasoning of her colleague Judge Neil Cohen, who rejected similar suits in September. Cohen found that it wasn't the law schools' fault that their alums joined the work force at the height of a recession that "seriously affected employment in the legal profession."

    The dismissals confirm what several experts told Reuters in February. In order for the suits to succeed, plaintiffs faced a very high bar, said Brian Leiter, a professor at University of Chicago College of Law. Graduates would most likely have to prove, for example, that they wouldn't have gone to law school at all if it weren't for the fudged data. What's more, their battle for class certification would be an uphill one because individual questions, not common ones, would be central to such cases.

    But University of California at Berkeley's Mark Gergen said some of the claims might have merit if plaintiffs could prove the schools posted employment numbers they knew to be wrong or misleading. Those sorts of questions could come into play in a suit filed against San Diego's Thomas Jefferson School of Law. Last month, a former career-services employee said she was told to mark certain graduates as employed, even if they no longer were.”

    Keep in mind that the pigs and cockroaches at Westlaw are not neutral bystanders. These leeches owe their existence to the law school cartel - and the federal student loan $y$tem. They certainly do not want to see fewer ABA-accredited commodes. Plus, the piece of trash known as Brian Leiter will defend his sick indu$try to his dying breath. If the ass-clown is anywhere near as intelligent as he wants others to believe, then he is smart enough to KNOW that the law schools are pulling a fast one on consumers/students and taxpayers. This is not a case of a man not comprehending something that he is being paid to not understand.

  13. This was a granting of summary judgment, correct? It sounds like this judge was acting as a finder of fact, i.e. it should have at least gone before a jury. Of course the judges are going to dismiss all of these suits because if just one succeeds the scam is over.

    Check out this November 12, 2012 piece, from Karen Sloan, which appeared in the Connecticut Law Tribune. The article was labeled "Judge rejects fraud claims against two law schools." Look at this relevant portion:

    "Mikva heard more than an hour of oral arguments in the John Marshall case before ruling from the bench. Instead of writing a separate opinion, she cited her colleague Judge Neil Cohen's dismissal the nearly identical case against DePaul. Cohen ruled that the allegations of fraud were too broad and the damage claims too speculative. Cohen and Mikva agreed that the Illinois Consumer Fraud Act does not apply to educational institutions.

    Mikva heard arguments in the Chicago-Kent case directly afterward, and made a similar ruling.

    "We are very grateful and gratified by the ruling," said Jeanne Hartig, vice president for communications at Chicago-Kent. "We maintained from the beginning that the case did not have merit, and we are delighted that the judge agreed."

    As you can see, this bitch didn't even bother writing a separate opinion for the case against "The" John Marshall Law Sewer. She simply cited to another pig's decision in a different case. What a beacon of integrity, right?!?!

    On May 30, 2009, Huffington Post writer Ryan Grim published an article entitled “Dick Durbin: Banks "Frankly Own The Place." Let the following excerpt sink in for a moment:

    That statement came from a sitting U.$. $enator, not an angry law grad or scamblogger. Those with an IQ above 75 realize that this is true. However, it is quite telling that a member of the senate felt the need to make this public admission. Politicians - especially those in black dresses - are NOT going to stand in the way of their corporate/financial overlords and masters. Students and grads will continue to be pushed into the meat grinder. In the end, the pigs see these consumers as mere "collateral damage.

So what if her father was successful? Why should she be treated negatively because she was lucky enough to have a successful benefactor? She obviously excelled to the opportunities presented to her.
